Constitutional Amendment (Ch. 511 of the 2016 Legislative Session)
Appointments and Special Elections for Attorney General or Comptroller

Changes the way the Governor fills a vacancy of the Attorney General or the Comptroller and requires a special election for vacancies that occur on or before a certain date. Under current law, the Governor fills a vacancy by appointing an individual to serve for the remainder of the term. Under the amended law, if the vacating Attorney General or Comptroller was a member of a political party, the Governor must fill the vacancy from a list of three names provided by the political party of the vacating official, and if no names are provided by the political party within a set time period, then the Governor must select a successor from the political party of the vacating official. If the vacating Attorney General or Comptroller was not a member of a political party, then the amended law requires the Governor to appoint any qualified individual. The Governor must make the appointment within a set time period following the vacancy. The amended law requires a special election to replace the successor if the vacancy occurs early enough in the term to allow for candidates to participate in the regular elections held in the second year of the vacating official's term.

Resolution No. 16-26 is for the purpose of amending the Baltimore City Charter to establish a continuing, non-lapsing Children and Youth Fund to be used exclusively to provide supplemental funding to broadly defined services for children and youth. The Fund may not be used to substitute or replace funding for children and youth programs and services that are provided for in the FY17 ordinance of estimates. A mandatory amount of $0.03 of every $100 of assessed value of real property in the City must be appropriated to this Fund annually. This allocation is permanent and not subject to discretion in the budget process, other fiscal priorities or constraints imposed by revenue limitations. The Resolution authorizes the Mayor and City Council, by Ordinance, to provide for the oversight, governance, and administration of the Fund.

Affordable Housing Trust Fund

The petition is for the purpose of amending the Baltimore City Charter to establish a continuing, non-lapsing Affordable Housing Trust Fund to be used exclusively to provide broadly defined projects and programs related to establishing and preserving affordable housing in Baltimore City. Revenue for the Fund is as provided in the Ordinance of Estimates, grants and donations, mandatory and voluntary payments made pursuant to ordinances establishing development policy, a portion of tax increment financing revenue and any other source established by ordinance. These allocation methods are not subject to discretion in the budget process, other fiscal priorities or constraints imposed by revenue limitations. The Petition authorizes oversight, governance, and administration of the Fund by the Department of Housing and Community Development and a 12 member commission.

Section 1203 is added to the Charter of Baltimore County to provide for the appointment by the County Council and County Executive of a Charter Review Commission in the seventh year of each decade. The Commission shall review and study the Charter and make findings and recommendations as to the necessity for deleting, adding to or amending its provisions in order to improve its efficiency and the operations of county government. The Commission shall hold at least one public hearing and, by October 15 of the year in which the Commission is appointed, shall submit a report of its findings to the County Council and County Executive, including drafts of any recommended revisions to the Charter. Citizens' Election Fund System

Amending the Howard County Charter to require the County Council to pass a law establishing a Citizens' Election Fund System that includes public funding for the campaigns of candidates for county executive or county council, or both. The express legislative purposes for the Amendment include that any System to be proposed for adoption by the Council would promote and encourage broader access to elective office in Howard County, enable County citizens to run for office on the strength of their ideas, and provide for small donations by citizens and matching public funds. The Council law must allow candidates to choose whether to participate in the System, and must establish a commission of County residents to determine annually the amount of County funding required to fully fund the System for the full election cycle for the ensuing fiscal year. The County Executive's proposed annual budget must include the required amount, but if the Executive does not include that amount, the Council can add the required amount to the proposed budget. The Executive's proposed annual budget does not have to include the required amount if funds are transferred from the "rainy day fund" to the current expense budget during the current fiscal year, or the Executive certifies that the County's fiscal condition makes it imprudent to include the required amount, and the Council approves the certification by a two-thirds vote. Unspent money in the Citizens' Election Fund at the end of the fiscal year would not lapse into the County treasury.

Changes to Budgetary and Fiscal Procedures

Amending the Howard County Charter to require that the County's annual budget include a contingency reserve in the current expense budget and a contingency reserve capital project in the capital budget. Any appropriation for the contingency reserve in the current expense budget could not be greater than 3% of the amount of money in the general fund. The County Council's budget authority would be expanded by allowing the Council to increase appropriations in the annual County budget for the contingency reserve and the contingency reserve capital project required by this proposed Charter amendment, and for the retiree obligations trust. The County Executive's budget authority would be decreased by requiring, instead of allowing, the Executive to include a contingency reserve in the current expense budget and a contingency reserve capital project in the capital budget.

The members of the Wicomico County Board of Education are currently appointed by the Governor. The referendum presents three options for how the seven members of the board should be chosen:

Option 2 - change to an elected board, with five members elected by voters within the voters' council district and two at-large members elected by all voters of Wicomico County;
